Terms of Use.

1. Acceptance of terms

By accessing or using the Alba Property Management Inc. website at albapm.ca (the "Site"), you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use the Site. These terms apply to all visitors, owners, residents, board members, and prospective clients of Alba Property Management Inc. ("Alba", "we", "us", or "our").

2. Permitted use of the site

You may use the Site for lawful purposes only, including:

• Learning about Alba and our condominium management services
• Submitting proposal inquiries and contact-form messages
• Submitting status certificate requests as a purchaser, seller, owner, or legal representative
• Accessing publicly available resources, links, and reference material

3. Prohibited conduct

You agree not to:

• Use the Site in any manner that violates any applicable federal, provincial, or local law
• Attempt to gain unauthorized access to any portion of the Site, our servers, or related systems
• Use any automated means — including scrapers, bots, or crawlers — without our prior written consent
• Transmit viruses, malicious code, or harmful content through the Site
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Use information obtained from the Site for unsolicited commercial communication

4. Accuracy of information

You agree that all information you submit through the Site — including in proposal inquiries, contact forms, and status certificate requests — is accurate, current, and complete to the best of your knowledge. We may decline to process or respond to any submission that we reasonably believe contains inaccurate, misleading, or fraudulent information.

5. Status certificate requests

Status certificate requests submitted through the Site are subject to the requirements of the Condominium Act, 1998 (Ontario) and Alba's published fees and turnaround times. Submission of a request does not constitute a contract for service until Alba has confirmed receipt and payment instructions have been issued.

The standard turnaround is ten (10) business days from receipt of a valid request and payment. Rush turnaround and electronic or hard-copy delivery options are available subject to additional fees. Alba will not issue a status certificate for a corporation it does not manage.

6. Intellectual property

All content on the Site — including the Alba Property Management name and logo, text, graphics, images, layouts, and source code — is the property of Alba or its licensors and is protected by Canadian and international intellectual property laws. You may not reproduce, distribute, modify, publish, transmit, or create derivative works from any content on the Site without our prior written consent, except for personal, non-commercial reference.

7. Third-party links

The Site contains links to third-party websites — including the Government of Ontario, the Condominium Authority of Ontario, and the Association of Condominium Managers of Ontario — for your convenience. These websites are not under our control, and we are not responsible for their content, privacy practices, or availability. Inclusion of any link does not constitute endorsement.

8. Disclaimer of warranties

The Site and all content, materials, and services made available through it are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Alba does not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses, or that the information contained on it is accurate, complete, or current. Nothing on the Site is intended to constitute legal, accounting, or professional advice.

9. Limitation of liability

To the maximum extent permitted by law, Alba Property Management Inc. and its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or related to your access to or use of the Site, even if Alba has been advised of the possibility of such damages.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

10. Indemnity

You agree to indemnify and hold harmless Alba Property Management Inc. and its directors, officers, employees, and agents from and against any claims, demands, losses, damages, costs, or expenses — including reasonable legal fees — arising out of your breach of these Terms of Use, your violation of any law, or your infringement of the rights of any third party.

11. Governing law

These Terms of Use are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree to submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any dispute arising out of or related to these terms or your use of the Site.

12. Changes to these terms

We may update these Terms of Use from time to time without prior notice. The "Last updated" date at the top of this page indicates when the terms were most recently revised. Your continued use of the Site after any change constitutes your acceptance of the revised terms. We encourage you to review this page periodically.
